(II.26.) korm\u00e1nyrendelet a Fogyaszt\u00f3 \u00e9s a v\u00e1llalkoz\u00e1s k\u00f6z\u00f6tti szerz\u0151d\u00e9sek r\u00e9szletes szab\u00e1lyair\u00f3l<\/p><p>Az Eur\u00f3pai Parlament \u00e9s Tan\u00e1cs (EU) 2016\/679. rendelete (2016.04.27.) a term\u00e9szetes szem\u00e9lyek szem\u00e9lyes adatainak kezel\u00e9s\u00e9r\u0151l \u00e9s v\u00e9delm\u00e9r\u0151l, tov\u00e1bb\u00e1 ezen adatok szabad \u00e1raml\u00e1s\u00e1r\u00f3l, valamint a 95\/46\/EK rendelet, azaz az \u00e1ltal\u00e1nos adatv\u00e9delmi rendelet hat\u00e1lyon k\u00edv\u00fcl helyez\u00e9s\u00e9r\u0151l<\/p><p>Az Eur\u00f3pai Parlament \u00e9s Tan\u00e1cs (EU) 2018\/302. rendelete (2018.02.28.) a bels\u0151 piacon bel\u00fcl a Fogyaszt\u00f3 \u00e1llampolg\u00e1rs\u00e1ga, lak\u00f3\/leteleped\u00e9si helye alapj\u00e1n val\u00f3 indokolatlan ter\u00fcleti alap\u00fa tartalomkorl\u00e1toz\u00e1ssal \u00e9s a megk\u00fcl\u00f6nb\u00f6ztet\u00e9s egy\u00e9b form\u00e1ival szembeni fell\u00e9p\u00e9sr\u0151l, valamint a 2006\/2004\/EK \u00e9s az (EU) 2017\/2394. rendelete, tov\u00e1bb\u00e1 a 2009\/22\/EK ir\u00e1nyelv m\u00f3dos\u00edt\u00e1s\u00e1r\u00f3l<\/p><p>A fogyaszt\u00f3 \u00e9s v\u00e1llalkoz\u00e1s k\u00f6z\u00f6tti, az \u00e1ruk ad\u00e1sv\u00e9tel\u00e9re, valamint a digit\u00e1lis tartalom szolg\u00e1ltat\u00e1s\u00e1ra \u00e9s digit\u00e1lis szolg\u00e1ltat\u00e1sok ny\u00fajt\u00e1s\u00e1ra ir\u00e1nyul\u00f3 szerz\u0151d\u00e9sek r\u00e9szletes szab\u00e1lyair\u00f3l sz\u00f3l\u00f3 373\/2021. (VI. 30.) Korm. rendelet<\/p><p><b> <\/b><\/p><p><b> <\/b><\/p><p><b>\u00c1SZF hat\u00e1lya \u00e9s elfogad\u00e1sa:<\/b><\/p><p>A vonatkoz\u00f3 jogszab\u00e1lyok mellett a megk\u00f6t\u00e9sre ker\u00fcl\u0151 szerz\u0151d\u00e9s tartalm\u00e1t \u00c1ltal\u00e1nos szerz\u0151d\u00e9si felt\u00e9teleink is szab\u00e1lyozz\u00e1k. Ennek keretein bel\u00fcl \u00f6sszefoglaljuk az \u00d6nt \u00e9s minket megillet\u0151 jogokat, k\u00f6telezetts\u00e9geket, a szerz\u0151d\u00e9sk\u00f6t\u00e9s felt\u00e9teleit, a fizet\u00e9si, illetve sz\u00e1ll\u00edt\u00e1si felt\u00e9teleket, a hat\u00e1rid\u0151ket, a felel\u0151ss\u00e9ggel kapcsolatos szab\u00e1lyokat, tov\u00e1bb\u00e1 az el\u00e1ll\u00e1si jog gyakorl\u00e1s\u00e1nak felt\u00e9teleit.<\/p><p>\u00d6n rendel\u00e9se lead\u00e1s\u00e1val elfogadja C\u00e9g\u00fcnk \u00c1ltal\u00e1nos szerz\u0151d\u00e9si felt\u00e9teleit, mely a megk\u00f6t\u00e9sre ker\u00fcl\u0151 szerz\u0151d\u00e9shez tartozik.<\/p><p><b> <\/b><\/p><p><b>Szerz\u0151d\u00e9s nyelve \u00e9s form\u00e1ja:<\/b><\/p><p>A szerz\u0151d\u00e9s nyelve magyar.<\/p><p>A szerz\u0151d\u00e9s a megrendel\u00e9s lead\u00e1s\u00e1val j\u00f6n l\u00e9tre, \u00c1ltal\u00e1nos szerz\u0151d\u00e9si felt\u00e9teleink elfogad\u00e1s\u00e1val.<\/p><p><b> <\/b><\/p><p><b>\u00c1rak:<\/b><\/p><p>Az \u00e1rak forintban \u00e9s eur\u00f3ban \u00e9rtend\u0151k. C\u00e9g\u00fcnk \u00c1FA k\u00f6rbe tartozik, \u00e1raink brutt\u00f3 \u00e1rak, melyek az \u00c1F\u00c1t tartalmazz\u00e1k. Fenntartjuk az \u00e1rv\u00e1ltoztat\u00e1s jog\u00e1t.<\/p><\/div><div class=\"thrv_wrapper thrv_text_element\">\t<p><b>Panasz\u00fcgyint\u00e9z\u00e9s \u00e9s jog\u00e9rv\u00e9nyes\u00edt\u00e9si lehet\u0151s\u00e9gek:<\/b><\/p><p>A Fogyaszt\u00f3 a Szolg\u00e1ltat\u00e1sokat, illet\u0151leg C\u00e9g\u00fcnk tev\u00e9kenys\u00e9g\u00e9t illet\u0151 kifog\u00e1sait a k\u00f6vetkez\u0151 el\u00e9rhet\u0151s\u00e9geinken juttathatja el hozz\u00e1nk:<\/p><p>E-mail c\u00edm: hello@retreatfactory.hu<\/p><p>Telefonsz\u00e1m: +3670 7720628<\/p><p>A Fogyaszt\u00f3<b> els\u0151sorban \u00edr\u00e1sban, egyes esetekben azonban sz\u00f3ban is k\u00f6z\u00f6lheti C\u00e9g\u00fcnkkel panasz\u00e1t<\/b>. A panasz vonatkozhat a C\u00e9g\u00fcnk r\u00e9sz\u00e9r\u0151l elj\u00e1r\u00f3 szem\u00e9ly viselked\u00e9s\u00e9re, munk\u00e1j\u00e1ra, esetleg mulaszt\u00e1s\u00e1ra, mely a szolg\u00e1ltat\u00e1s \u00e9rt\u00e9kes\u00edt\u00e9s\u00e9vel k\u00f6zvetlen kapcsolatban \u00e1ll.<\/p><p><b>A sz\u00f3beli panaszt C\u00e9g\u00fcnk halad\u00e9ktalanul kivizsg\u00e1lja \u00e9s lehet\u0151s\u00e9g szerint megoldja<\/b>. Amennyiben a Fogyaszt\u00f3 nem \u00e9rt egyet a panasz kezel\u00e9s\u00e9vel vagy a panasz halad\u00e9ktalan kivizsg\u00e1l\u00e1sa nem lehets\u00e9ges, C\u00e9g\u00fcnk a panaszr\u00f3l \u00e9s azzal kapcsolatos \u00e1ll\u00e1spontj\u00e1r\u00f3l jegyz\u0151k\u00f6nyvet vesz fel, melynek m\u00e1solati p\u00e9ld\u00e1ny\u00e1t eljuttatja a Fogyaszt\u00f3 r\u00e9sz\u00e9re (szem\u00e9lyes jelenl\u00e9t eset\u00e9n helyben \u00e1tadja). E-mailen \u00e9rkezett panasz eset\u00e9ben 30 napon bel\u00fcl a v\u00e1lasszal egy\u00fctt megk\u00fcldi a Fogyaszt\u00f3 r\u00e9sz\u00e9re. <b>Az \u00edr\u00e1sbeli panaszt C\u00e9g\u00fcnk a be\u00e9rkez\u00e9st\u0151l sz\u00e1m\u00edtott 30 napon bel\u00fcl \u00edr\u00e1sban megv\u00e1laszolja<\/b>. A panasz elutas\u00edt\u00e1sa eset\u00e9n C\u00e9g\u00fcnk \u00e1ll\u00e1spontj\u00e1t k\u00f6teles megindokolni. C\u00e9g\u00fcnk k\u00f6teles a panaszt egyedi azonos\u00edt\u00f3sz\u00e1mmal ell\u00e1tni - telefonon, illetve egy\u00e9b elektronikus h\u00edrk\u00f6zl\u00e9si szolg\u00e1ltat\u00e1s \u00fatj\u00e1n k\u00f6z\u00f6lt sz\u00f3beli panasz eset\u00e9n.<\/p><p>Tartalmaznia kell a panaszr\u00f3l felvett jegyz\u0151k\u00f6nyvnek:<\/p><p>Panasz eljuttat\u00e1s\u00e1nak hely\u00e9t, m\u00f3dj\u00e1t, idej\u00e9t<\/p><p>Fogyaszt\u00f3 nev\u00e9t, lakc\u00edm\u00e9t, el\u00e9rhet\u0151s\u00e9g\u00e9t<\/p><p>Fogyaszt\u00f3i panasz r\u00e9szletes le\u00edr\u00e1s\u00e1t, tov\u00e1bb\u00e1 a dokumentumok, iratok, bizony\u00edt\u00e9kok jegyz\u00e9k\u00e9t<\/p><p>C\u00e9g\u00fcnk nyilatkozat\u00e1t a Fogyaszt\u00f3i panaszt \u00e9rint\u0151 \u00e1ll\u00e1spontj\u00e1r\u00f3l, ha annak halad\u00e9ktalan kivizsg\u00e1l\u00e1sa megoldhat\u00f3<\/p><p>Jegyz\u0151k\u00f6nyv felv\u00e9tel\u00e9nek hely\u00e9t \u00e9s idej\u00e9t<\/p><p>Jegyz\u0151k\u00f6nyvet felvev\u0151 szem\u00e9ly- \u00e9s a Fogyaszt\u00f3 al\u00e1\u00edr\u00e1s\u00e1t - ez ut\u00f3bbit abban az esetben, amennyiben szem\u00e9lyes jelenl\u00e9ttel t\u00f6rt\u00e9nik a sz\u00f3beli panasz k\u00f6zl\u00e9se<\/p><p>A panasz egyedi azonos\u00edt\u00f3sz\u00e1m\u00e1t \u2013 telefonon, illetve egy\u00e9b elektronikus h\u00edrk\u00f6zl\u00e9si szolg\u00e1ltat\u00e1s \u00fatj\u00e1n k\u00f6z\u00f6lt sz\u00f3beli panasz eset\u00e9n<\/p><p>C\u00e9g\u00fcnk a panaszr\u00f3l felvett jegyz\u0151k\u00f6nyvet \u00e9s v\u00e1lasszunk m\u00e1solati p\u00e9ld\u00e1ny\u00e1t 5 \u00e9vig meg\u0151rzi, ellen\u0151rz\u0151 hat\u00f3s\u00e1g k\u00e9r\u00e9s\u00e9re bemutatja.<\/p><p>C\u00e9g\u00fcnk a Fogyaszt\u00f3t \u00edr\u00e1sban t\u00e1j\u00e9koztatja, amennyiben a panaszt elutas\u00edtja, hogy panasz\u00e1val mely hat\u00f3s\u00e1g vagy B\u00e9k\u00e9ltet\u0151 Test\u00fclet elj\u00e1r\u00e1s\u00e1t kezdem\u00e9nyezheti. Tartalmazza a t\u00e1j\u00e9koztat\u00e1s az illet\u00e9kes hat\u00f3s\u00e1g \u00e9s a Fogyaszt\u00f3 lak\u00f3helye\/tart\u00f3zkod\u00e1si helye szerinti B\u00e9k\u00e9ltet\u0151 Test\u00fclet sz\u00e9khely\u00e9t, levelez\u00e9si c\u00edm\u00e9t, el\u00e9rhet\u0151s\u00e9geit (weboldal, e-mail, telefonsz\u00e1m), valamint C\u00e9g\u00fcnk Fogyaszt\u00f3i jogvita rendez\u00e9se c\u00e9lj\u00e1b\u00f3l t\u00f6rt\u00e9n\u0151 B\u00e9k\u00e9ltet\u0151 Test\u00fcleti elj\u00e1r\u00e1s ig\u00e9nybev\u00e9tel\u00e9vel kapcsolatos \u00e1ll\u00e1spontj\u00e1t.<\/p><p><br>Abban az esetben, ha C\u00e9g\u00fcnk \u00e9s a Fogyaszt\u00f3 k\u00f6z\u00f6tti jogvita t\u00e1rgyal\u00e1sok \u00fatj\u00e1n sem rendez\u0151dik, tov\u00e1bbi jog\u00e9rv\u00e9nyes\u00edt\u00e9si lehet\u0151s\u00e9gekkel \u00e9lhet a Fogyaszt\u00f3:<\/p><p><br><b>Fogyaszt\u00f3v\u00e9delmi Hat\u00f3s\u00e1gi elj\u00e1r\u00e1s:<\/b><\/p><p>A Fogyaszt\u00f3i jogok megs\u00e9rt\u00e9se eset\u00e9n a Fogyaszt\u00f3 jogosult panaszt tenni a lak\u00f3helye szerint illet\u00e9kes Fogyaszt\u00f3v\u00e9delmi Hat\u00f3s\u00e1gn\u00e1l. A hat\u00f3s\u00e1g d\u00f6nt a Fogyaszt\u00f3v\u00e9delmi elj\u00e1r\u00e1s lefolytat\u00e1s\u00e1r\u00f3l a panasz elb\u00edr\u00e1l\u00e1s\u00e1t k\u00f6vet\u0151en. Az els\u0151fok\u00fa hat\u00f3s\u00e1gi feladatokat a j\u00e1r\u00e1si hivatalok l\u00e1tj\u00e1k el. El\u00e9rhet\u0151s\u00e9g\u00fck: <u><a href=\"https:\/\/jarasinfo.gov.hu\/jarasok-lista\">http:\/\/jarasinfo.gov.hu\/<\/a><\/u><\/p><p><b> <\/b><\/p><p><b>B\u00edr\u00f3s\u00e1gi elj\u00e1r\u00e1s:<\/b><\/p><p>A Fogyaszt\u00f3 polg\u00e1ri elj\u00e1r\u00e1s keretein bel\u00fcl jogosult a jogvit\u00e1b\u00f3l sz\u00e1rmaz\u00f3 k\u00f6vetel\u00e9s\u00e9nek b\u00edr\u00f3s\u00e1g el\u0151tti \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9re a Polg\u00e1ri T\u00f6rv\u00e9nyk\u00f6nyvr\u0151l sz\u00f3l\u00f3 2013. \u00e9vi V. t\u00f6rv\u00e9ny, valamint a Polg\u00e1ri Perrendtart\u00e1sr\u00f3l sz\u00f3l\u00f3 2016. \u00e9vi CXXX. t\u00f6rv\u00e9ny rendelkez\u00e9sei szerint.<\/p><p><b> <\/b><\/p><p><b>B\u00e9k\u00e9ltet\u0151 Test\u00fcleti elj\u00e1r\u00e1s:<\/b><\/p><p>Jogosult a lak\u00f3helye\/tart\u00f3zkod\u00e1si helye szerint illet\u00e9kes B\u00e9k\u00e9ltet\u0151 Test\u00fclethez fordulni, ha Fogyaszt\u00f3i panasz\u00e1t elutas\u00edtjuk. Az elj\u00e1r\u00e1s megind\u00edt\u00e1s\u00e1nak felt\u00e9tele, hogy a Fogyaszt\u00f3 C\u00e9g\u00fcnkkel k\u00f6zvetlen\u00fcl megk\u00eds\u00e9relje a vit\u00e1s \u00fcgy rendez\u00e9s\u00e9t.<\/p><p><br>A B\u00e9k\u00e9ltet\u0151 Test\u00fcleti elj\u00e1r\u00e1sban C\u00e9g\u00fcnket egy\u00fcttm\u0171k\u00f6d\u00e9si k\u00f6telezetts\u00e9g terheli. Ez alapj\u00e1n C\u00e9g\u00fcnk k\u00f6teles a B\u00e9k\u00e9ltet\u0151 Test\u00fclet felh\u00edv\u00e1s\u00e1ra <b>v\u00e1lasziratot megk\u00fcldeni<\/b>, valamint a B\u00e9k\u00e9ltet\u0151 Test\u00fclet el\u0151tti meghallgat\u00e1son <b>megjelenni<\/b> \u00e9s<b> <\/b>egyezs\u00e9g l\u00e9trehozatal\u00e1ra feljogos\u00edtott szem\u00e9ly r\u00e9szv\u00e9tel\u00e9t biztos\u00edtani.<\/p><p>Ha C\u00e9g\u00fcnk sz\u00e9khelye\/telephelye a ter\u00fcletileg illet\u00e9kes B\u00e9k\u00e9ltet\u0151 Test\u00fcletet m\u0171k\u00f6dtet\u0151 kamara szerinti megy\u00e9n k\u00edv\u00fcl tal\u00e1lhat\u00f3, C\u00e9g\u00fcnk egy\u00fcttm\u0171k\u00f6d\u00e9si k\u00f6telezetts\u00e9ge a Fogyaszt\u00f3i ig\u00e9ny megfelel\u0151 \u00edr\u00e1sbeli egyezs\u00e9gk\u00f6t\u00e9s lehet\u0151s\u00e9g\u00e9nek felaj\u00e1nl\u00e1s\u00e1ra terjed ki.<\/p><p>Amennyiben fenti egy\u00fcttm\u0171k\u00f6d\u00e9si k\u00f6telezetts\u00e9g\u00fcnknek nem tesz\u00fcnk eleget, a Fogyaszt\u00f3v\u00e9delmi Hat\u00f3s\u00e1g hat\u00e1sk\u00f6r\u00e9be ker\u00fcl az \u00fcgy, mely szerint a c\u00e9gek jogs\u00e9rt\u0151 magatart\u00e1sakor <b>k\u00f6telez\u0151 b\u00edrs\u00e1g kiszab\u00e1sa<\/b> van \u00e9rv\u00e9nyben, ett\u0151l eltekinteni nem lehet.<\/p><p>A b\u00edrs\u00e1g \u00f6sszege kis- \u00e9s k\u00f6z\u00e9pv\u00e1llalkoz\u00e1s sz\u00e1m\u00e1ra 15.000 - 500.000 Ft-ig, 100 milli\u00f3 Ft feletti \u00e9ves nett\u00f3 \u00e1rbev\u00e9tellel rendelkez\u0151 nagyv\u00e1llalat sz\u00e1m\u00e1ra pedig 15.000 Ft-t\u00f3l a v\u00e1llalat \u00e9ves nett\u00f3 \u00e1rbev\u00e9tel\u00e9nek 5%-\u00e1ig, legfeljebb 500 milli\u00f3 Ft-ig terjedhet.<\/p><p><br>A Fogyaszt\u00f3 k\u00e9relmezheti a B\u00e9k\u00e9ltet\u0151 Test\u00fcleti elj\u00e1r\u00e1s megind\u00edt\u00e1s\u00e1t.
